Terms of service

The agreement between the operator of this installation and the organisations using it.

This text has not been reviewed by a lawyer.

Mauqe ships these notices as a starting point for whoever operates this installation. Before you rely on them, have them reviewed against the law that applies to you and fill in every part marked as needing completion.

The agreement

These terms are between the operator named above and the organisation whose workspace is being used. Whoever creates a workspace confirms they are entitled to accept these terms for that organisation. If a signed contract exists with the operator, that contract wins wherever the two disagree.

The service

Mauqe is a platform for building business applications: forms, records, approvals, dashboards, published pages and an API. What is included in a given plan, and the quotas attached to it, are what the plan page states at the time of purchase.

Accounts

You are responsible for the accounts in your workspace and for what is done with them. Keep credentials secret, remove people who leave, and tell the operator promptly if you believe an account has been taken over. Accounts are for named individuals; sharing one between people makes the audit trail meaningless.

Acceptable use

Do not use the service to break the law, to store material you have no right to store, to attack or overload this or any other system, to probe another tenant's data, or to resell access as your own product without a written agreement. Automated use through the API must stay within the published rate limits.

Your data

The records you create remain yours. The operator claims no ownership of them and uses them only to provide the service, to keep it secure, and to comply with the law. You may export them at any time. You are responsible for having the right to collect whatever your forms collect, and for telling the people who fill them in what happens to it.

Availability

The service is provided as it stands, without an uptime commitment, unless the operator has agreed one in writing. Maintenance that requires downtime will be announced in advance where it can be. A self-hosted installation is available exactly as often as the operator's own infrastructure is.

Fees

Paid plans are billed in advance for the period chosen and are not refundable for a period already begun, except where the law says otherwise. Prices can change, but not during a period already paid for, and a change is notified before the next renewal. Unpaid subscriptions may be suspended after notice.

Intellectual property

The software, its interface and its documentation belong to their authors. Nothing here transfers ownership of them. Applications you build with the product — your schemas, your rules, your content — are yours.

Self-hosting

If you run Mauqe on your own infrastructure, the licence that came with the software governs that use, and you are the operator: security, backups, updates and every obligation to your own users are yours. These terms then bind you to whoever uses your installation, not to anyone else.

Suspension and termination

Either side may end the agreement with notice. The operator may suspend a workspace immediately where use of it is unlawful, threatens the service, or the fees are unpaid after a reminder. On termination you have a stated window to export your data, after which it is deleted along with its backups on the usual cycle.

Warranties

The service is provided “as is”. To the extent the law allows, no implied warranty of merchantability, fitness for a particular purpose or non-infringement is given. Nothing here excludes rights that your law does not permit to be excluded.

Liability

To the extent the law allows, neither side is liable for indirect or consequential loss, lost profits or lost data, and each side's total liability is limited to the fees paid in the twelve months before the claim. Nothing limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.

Governing law

The law that governs this agreement, and the courts that decide a dispute under it, must be stated by the operator. They are left blank on purpose: the right answer depends on where the operator is established and where its customers are.

Changes to these terms

The operator may update these terms. A material change is notified before it takes effect, and continuing to use the service after that date is acceptance of it. If you do not accept a change you may end the agreement and be refunded the unused part of a period paid in advance.
